How to Verify Title Deed Before Buying Land in Kenya - Complete Guide

Buying land in Kenya? Don't be conned. 70% of plots in Coast have title issues. Here is how smart investors verify title deed before paying.

As High End Property (k) Ltd, we never sell land without doing full due diligence for our clients. Here is the process you should follow:

Step 1: Get Copy of Title Deed

Ask seller for clear copy of title deed. Check:

- Title number: e.g. KILIFI/KIKAMBALA/1234

- Size matches what seller says (2.7 acres, 5.2 acres etc)

- Owner name matches ID of seller

- Is it Freehold or Leasehold? . 

Note: Leasehold expires after 99 years but are renewable.

Step 2: Green Card Search at Lands Office (Most Important)

Go to Lands Office with copy of title.

- Pay Kshs 500 for official search

- You will get Green Card showing history of land, all owners, any loans or caveats

- If search shows "No encumbrance" = Clean title

Step 3: Map & Beacons Verification (RIM & Survey)

- Get mutation / RIM map from survey office

- Hire surveyor (Kshs 10,000) to confirm beacons on ground match map

Step 4: Check With Physical Planning & NEMA

- Confirm Riparian reserve.

- Confirm building approval requirements 

Step 5: Confirm Rates & Land Rent

- Ask for rates clearance certificate from County

- Land rent clearance from Ministry of Lands

- No arrears.

Step 6: Sale Agreement & Transfer

Use a lawyer. Payment should be through escrow or bank transfer, never cash.

Red Flags to Avoid:

- Title says "Provisional" or "Certificate of Lease" without mother title

- Seller rushes you "Lipa haraka"

- Price too cheap - e.g. 1 acre beachfront at 10M in Nyali - must be fake

- No access road on map
